PRIZE DRAW TERMS AND CONDITIONS

1. THE PROMOTER
This prize draw (the ‘Prize Draw’) is jointly run and promoted by (i) in the UK, Sunrise Records and Entertainment Limited whose registered address is at Mermaid House, Puddle Dock, Blackfriars, London, EC4V 3DB, United Kingdom, (ii) in Ireland, Sunrise Records and Entertainment Ireland Limited whose registered address is 18 Henry Street, Dublin, D01 WA24, Ireland, and (iii) in Belgium, Sunrise Records and Entertainment Belgium BV whose registered address is Silversquare Antwerp Tower, Frankrijklei 5, 2000, Antwerpen, Belgium, and (iv) in The Netherlands Sunrise Records and Entertainment Belgium BV - Dutch Branch whose registered branch office is Spuistraat 29, 2511 BC Den Haag, The Netherlands, (together referred to as ‘HMV’). Entrants participate in the Prize Draw relevant to their country of residence.

2. THE PRIZE
2.1 The prize (the ‘Prize’) is a gift card for the value of £100 (for UK residents) or €100 (for residents of Ireland, Belgium, or The Netherlands) (the ‘Gift Card’). There is one Prize each month.
2.2 The Gift Card may be exchanged for goods in HMV stores in the United Kingdom, Ireland or Belgium, depending on the residence of each winner. The Gift Card cannot be used online.
2.3 Use of the Gift Card is subject to the terms and conditions of use which accompany the Gift Card.
2.4 The Prize is non-transferable, non-refundable, and non-changeable. There is no cash alternative to the Prize.
2.5 HMV reserves the right to temporarily suspend, cancel or vary the Prize Draw at any stage if deemed necessary in its opinion, or due to circumstances beyond its control.

3. TERMS AND CONDITIONS
By entering this Prize Draw you agree to be bound by the terms and conditions that are published on this page (the ‘Terms’).

4. HOW TO ENTER THE PRIZE DRAW
4.1 To enter the Prize Draw, customers of HMV and/or invited members of the public must complete an online survey about their shopping experience at HMV at www.hmv-hearmyvoice.com.
4.2 Entry to each Prize Draw shall start at 00:00 GMT on the first day of each month and close at 23:59 GMT on the final day of the month.
4.3 Entries received within each calendar month shall be entered into the Prize Draw for the corresponding month.
4.4 The final date for entries shall be 31 December 2026.
4.5 Your entry into the monthly Prize Draw will be registered as soon as the completed survey has been submitted.

5. ELIGIBILITY
5.1 The Prize Draw is open to legal residents of the United Kingdom, Ireland, Belgium, or The Netherlands who are at least eighteen (18) years old at the time of entry.
5.2 Only one entry per person is permitted per month. Use of multiple identities and emails is not permitted. Only entries via the official online survey shall be accepted. No third-party entries shall be accepted.
5.3 Employees (and their immediate families) of any of the entities in clause 1 or any of its group, affiliated or associated companies, agents or any other person connected with the Prize Draw are not permitted to enter.
5.4 HMV reserves the right to verify the eligibility of entrants to enter the Prize Draw.
5.5 No responsibility can be accepted for entries which are not properly received due to communications beyond the control of HMV.
5.6 If there are reasonable grounds to believe that there has been a breach of these Terms by an entrant, HMV may, at its sole discretion invalidate the relevant entry and disqualify the entrant from entry to the Prize Draw.

6. ALLOCATION OF PRIZES
6.1 The winners will be selected by means of a draw using a random computer process from all valid entries received once the Prize Draw for the relevant month has closed.
6.2 If a selected winner does not meet the eligibility criteria set out in these Terms, HMV reserves the right to re-draw and select an alternative winner.
6.3 Each winner shall receive either a £100 Gift Card (for UK residents) or a €100 Gift Card (for residents of Ireland, Belgium, or The Netherlands) and will be required to nominate their preferred HMV store location where they will collect the Gift Card. They will have to provide proof of identification to receive the Gift Card.

7. NOTIFICATION OF PRIZES
7.1 HMV shall use its reasonable endeavours to notify the winners within seven (7) days from the advertised closing date for entries.
7.2 HMV shall send the winners one email using the email address that was submitted when entering the Prize Draw. It is the responsibility of the entrant to ensure that a valid email address is submitted.
7.3 If HMV has not received a response from a winner within forty-eight (48) hours by email to confirm that they can accept the Prize, or where a winner does not meet any of the eligibility requirements, HMV reserves the right to redraw, and a new winner will be selected.
7.4 HMV cannot accept responsibility for any emails that do not reach the intended recipients for any reason whatsoever, including emails that may be flagged as spam.
7.5 The decision of HMV is final and no correspondence regarding the Prize allocation will be entered into.
7.6 Nothing in these Terms shall affect your statutory rights.

8. WINNERS
8.1 The winners may be required to participate in publicity connected with the Prize Draw and it is a condition of entry that entrants agree to their name being made publicly available if they win.
8.2 HMV must make available information that indicates that a valid award took place. To comply with this obligation, the names and county of the winners will be available on written request. Any such request must be made within one month of the closing date for the specific month of the Prize Draw, must include a stamped addressed envelope, and must clearly state which Prize Draw month the request relates to. Requests should be sent to: HMV Hear My Voice Prize Draw Winner Details, Mermaid House, Puddle Dock, Blackfriars, London, EC4V 3DB, United Kingdom. This disclosure requirement applies to UK winners only and is in line with UK advertising standards requirements.
8.3 If you are a winner and you object to any or all of your surname, county and winning entry being made available, please email [email protected]. In such circumstances, HMV must still provide the information and winning entry to the Advertising Standards Authority on request.

9. DATA PROTECTION
All personal information collected in connection with this Prize Draw will be used in accordance with the SMG Survey Privacy Notice available at www.hmv-hearmyvoice.com and the relevent privacy notice available at Privacy Notices.

10. GOVERNING LAW AND JURISDICTION
10.1 The Prize Draw and these Terms shall be governed by English law and are subject to the exclusive jurisdiction of the English courts. This governing law clause applies to all entrants regardless of country of residence.
10.2 If any of these Terms are found by a court or regulator to be invalid or unenforceable, the other provisions shall continue to apply.
