The HMV Shop, HMV, and FOPP in the United Kingdom are trading names of Sunrise Records and Entertainment Limited.

CCTV AND BODY-WORN CAMERAS

For enhanced security and safety, we use Closed-Circuit Television (CCTV) and body-worn cameras in selected stores. These measures are in place to protect our customers, employees, and property.

Purpose of CCTV and Body-Worn Cameras:

  • To prevent and detect crime.
  • To safeguard the safety and security of customers and employees.
  • To monitor and improve the quality of service provided in our stores.

Data Collection:

  • CCTV cameras capture video footage of activities within our stores. This footage is used exclusively for security and safety purposes.
  • Body-worn cameras which record both audio and video may be used by staff in selected stores to record interactions with customers and staff for security and training purposes.

Data Storage and Access:

  • CCTV footage and recordings from body-worn cameras are stored securely and access is limited to authorised personnel only.
  • Footage is retained only for as long as necessary to fulfil its purpose and is then securely deleted or archived in line with our data retention policies. Your Rights:
  • You have the right to request access to CCTV footage or body-worn camera recordings that may contain your image. Please direct such requests to our Data Protection Office using the contact details provided in this Privacy Notice.
  • We will manage these requests in accordance with applicable data protection laws and ensure that any disclosure of footage is handled appropriately.

The addition of the specific information requirements (date, time, store, and identifying information such as a recent photograph) will help streamline the process of fulfilling requests and ensure that the correct footage is retrieved. We may not be able to identify you or locate the relevant footage if information is not sufficient.


EVENT PERFORMERS

We occasionally collaborate with individuals to host live performances in our stores, typically called hmvlive&local and fopplive&local events. If you express interest in performing at one of our stores, staff in our stores may collect certain personal information from you to assess your suitability for an event. You can also submit your personal information through an online form on hmv.com.

Purpose of Collecting Personal Details:

  • When you approach us with an interest in performing, we may collect your name, contact information such as phone number and email address, and details about your experience and past performances.
  • If you are selected to perform, we may gather additional personal information, including identification details, and any specific requirements related to the proposed event.

Data Collection and Use:

  • The information you provide allows us to evaluate your suitability for performing in our stores, considering factors such as experience and style.
  • If selected, your details will be used to coordinate the event, including managing logistics and communicating event details.
  • We may contact you regarding future performance opportunities or related events. If you do not wish to be contacted, please advise the management of the relevant store.

EVENT PHOTOGRAPHY AND SOCIAL MEDIA

Occasionally, we host events in our stores, such as live music performances, listening parties, themed dress-up events, and more. While these events are primarily attended by those who are aware of them and some of them are ticketed events, there may also be individuals who are present in the store incidentally, and not directly participating. During these events, photos and videos may be taken, which could include images of these individuals at the event and in the background. When there is an event in any of our stores, this is clearly signposted at the entrance(s) to the store.

Purpose of Photography and Video Recording:

  • To capture and promote the events we host in our stores.
  • To share highlights and engage with our community through social media platforms, including but not limited to; Facebook, Instagram, X, TikTok.

Data Collection and Use:

  • Photos and videos taken during these events may feature individuals who are present in the background.
  • Such media may be used for promotional purposes, including sharing on our social media channels, our websites, and other marketing materials.

Consent and Your Rights:

  • By attending our events, you consent to the possibility of being photographed or recorded, this consent is obtained under legitimate interest. These images or videos may be shared on social media and other platforms for promotional purposes.
  • If you do not wish to be featured in any photos or videos, please notify our staff upon arrival. We will make reasonable efforts to accommodate your request and ensure that you are not included in any photography or recordings.
  • If a photographer approaches you and offers to take your photograph, and you do not wish to be photographed, please feel free to decline the offer.
  • If you discover that you have been featured in photos or videos and would like them removed from our social media or other channels, you may submit a request to our Data Protection Office. Please use the contact details provided in this Privacy Notice. We will address your request in accordance with applicable data protection laws.

We ask that members of the public seek permission before taking photographs or recording videos in our stores. However, we acknowledge that this does not always occur, and we have no control over how or where these images may be shared or posted. Please note that such images may be taken at any time, not solely during events.


SOCIAL MEDIA

We actively engage with both customers and potential customers to promote our products and events through various social media platforms, including but not limited to; Facebook, Instagram, X, TikTok, Discord, LinkedIn. This section explains how we manage personal data in connection with our social media activities.

Purpose of Data Collection and Use:

  • To interact with customers, respond to inquiries, and provide customer support through social media channels.
  • To promote our products, services, and events by sharing content, such as images, videos, and other media, on our social media pages.
  • To conduct marketing campaigns, prize draws, and promotions that may involve collecting and processing personal data, including names, usernames, and contact information.

LOCAL ARTISTS

When local artists (generally but not exclusively, singers and bands) request we sell their products in our stores, we need to collect their personal details to review the opportunity and facilitate the stocking of their goods and to manage our business relationship.

Purpose of Collecting Personal Details or local arrtists and/or their representatives:

  • To prepare and manage agreements for stocking and selling their products.
  • To contact them regarding their products and services.
  • To process and pay invoices related to their goods.
  • To maintain accurate records of our business transactions.
  • To assist with promotion of the products.

Data Collection and Use:

  • We collect personal details such as names, contact information, and bank details.
  • This information is used solely for the purpose of managing our agreement with them, processing payments, and handling any necessary communications.

WorldPay: For all financial transactions at Fopp and HMV stores, and hmv.com, we use WorldPay (UK) Limited as our payment services provider. We share your information with WorldPay only as necessary to process your payments, handle refunds, and address any related complaints or queries.

DATA RETENTION

OTHER TRACKING TECHNOLOGIES

In addition to cookies, we use your IP address and User Agent (which is a string of text sent by your web browser or application to our website during interactions), to collect non-personal information about your activity on hmv.com. When you visit hmv.com, your IP address and User Agent are assigned a random ID using SHA256 encryption. Once this encryption process is complete, the raw IP address and User Agent data are deleted. This tracking method ensures no personally identifiable information is captured and does not rely on cookies.

HOW INFORMATION IS KEPT SAFE

We implement stringent technical and organisational security measures to protect the personal information you provide. These measures are designed to prevent loss, unauthorised access, or unlawful processing of your data. Your information is kept confidential and stored on a secure, password-protected server that is shielded by a firewall. Despite our best efforts to secure your data, please note that we cannot guarantee the absolute security of information transmitted over the internet.

We (or our affiliates acting on our behalf) may store or process your information within the European Economic Area (EEA), in compliance with the General Data Protection Regulation (GDPR) 2018, the Privacy and Electronic Communications (EC Directive) Regulations 2015 (as amended), and any other applicable data protection legislation.

MISUSE OF PERSONAL DATA

RIGHT TO BE FORGOTTEN

  • When you request an hmv.com account closure and have a registered account with us, the account will be closed.
  • When you request an hmv.com account deletion and have a registered account with us, the account will be deleted, along with all your order details.
  • When you request an hmv.com account closure and data deletion, and have a registered account with us, the account will be deleted, and all your order details will be disassociated.
  • When you request data removal or deletion, all the data we hold will be deleted.
  • When you request a Right to be Forgotten, the data we hold will be deleted, along with any data we have made public or shared, using reasonable efforts to facilitate this request.
  • When you request a careers.hmv.com account closure and have a registered account with us, the account will be closed.
  • When you request a careers.hmv.com account deletion and have a registered account with us, the account will be deleted.

DISCLOSURE ON QUIVIDI ANONYMOUS MEASUREMENT SYSTEM

Sunrise Records and Entertainment Limited, as data controller, uses digital advertising systems located at selected retail stores in the UK, Ireland and Belgium that are equipped with a counting and measurement system produced by the company Quividi SAS.

The software does not record and does not broadcast any image or video; it only collects anonymous numerical descriptors in order to identify the number of bystanders at any given moment and their demographic composition (by way of gender and age estimate).

The images detected by the software are never stored. From a technical standpoint, each image is present only in the volatile memory of the computer for a very short period of time and then immediately overwritten without any recording. All the anonymous data generated and collected by the counting and measurement systems of the audience are treated exclusively with IT systems, encrypted and sent securely to the servers hosting the service.

The aggregate information is treated exclusively by us in compliance with the provisions of the General Data Protection Regulation 2018, the Privacy and Electronic Communications (EC Directive) Regulations 2015 as amended.

MENTION ME

We use a referral marketing programme from Mention Me Limited, Kennington Park, 1-3 Brixton Rd, London, SW9 6DE, United Kingdom. Through the Mention Me programme we enable you to recommend hmv.com to your friends. We then reward both you as the referrer and your referred friend, when your referred friend also becomes a customer of hmv.com.

For this purpose, your name and email address as the referrer will be shared with Mention Me in compliance with the GDPR so that Mention Me can operate the service on our behalf.

Once you make a purchase on hmv.com, an overlay will be shown. You can then freely decide whether you want to recommend someone or not. If you decide to do so, you will have the option of sending a personally created link to a friend by email, via Facebook, SMS or WhatsApp. Afterwards, both you and your recommended friend receive a reward for the recommendation, provided that the recommended friend has placed an order on hmv.com.

For this purpose, we will share personal data from you (email address, name and order details) in encrypted, pseudonymised form with Mention Me, so that you can participate in this programme. This makes it possible to determine which customer is the referee of a new customer and who should receive a reward for their referral. For this purpose, the email address, name and IP address of you as the recommender are processed. Also, the email address and IP address of the recommended friend are processed for this purpose, only once they freely enter their details in the ‘been referred by a friend’ link at the checkout. In both cases, data is shared exclusively in pseudonymised form.

The data is processed voluntarily and with your explicit consent only or based on consent of the recommended friend, Art. 6 sec. 1 lit. a GDPR. You can withdraw your consent at any time with effect for the future.

EXERTIS

We use Exertis (UK) Limited to fulfil orders for selected items ordered on hmv.com. These items can be identified on hmv.com as they will have the wording ‘*item fulfilled by Exertis on behalf of hmv' on the product page.

When you place an order for goods that are fulfilled by Exertis, your details shall be forwarded to Exertis so that they can fulfil the order and to DHL Parcel UK Limited so that they can deliver the goods.
